A bail that harassed, tortured and restricted

The State Police had no intention of closing the FAKE investigation. Keeping the FAKE case perpetually alive was their way of perpetually harassing and torturing His Divine Holiness. The inhumane bail conditions were kept alive perpetually. As long as the investigation continued, which may be for decades, His Divine Holiness' Human Rights would remain suspended. For example, the court had suspended His Divine Holiness' fundamental Human Right of Freedom of Speech until the investigation was over. There was no limit to how low the illegal 'investigation' could be kept alive. Counsel of His Divine Holiness had to pray to the courts for allowing Him to visit His village to take part in last rites of His grandmother (as can be seen reported in the newspaper clipping here).

His Divine Holiness was put to the ordeal of moving the court and applying for permission for every required travel, whether it was for the last rites ceremony of His Grandmother or the pilgrimage to Mount Kailash.

Why did they not want His Divine Holiness to speak after he leaves prison?

Torture is illegal in India. They tortured him for 8 days, completely against law and humanity. And then, when they could not find any evidence against Him, they released Him from the illegal arrest. They did not want Him to reveal to the world and to His many thousands of followers about the torture. To silent Him forcibly, they denied His fundamental Human Right & Freedom of Speech.

The 8-day State police (CID) torture:

• They threatened Him with encounters to force Him to make a false confession.
• No food or water was given to him for 8 days.
• They kept him hungry for days denying food and water. They would ridicule his sacred sentiments by forcing him to eat cow's meat knowing well that as a Hindu, he worshipped the co as a sacred being. Therefore He never ate anything.
• He was denied His rights to perform His religious rituals and denied using his sacred rosary beads.
• Basic human needs were denied to Him no bed or mattress was provided, instead there was only some thin paper on the floor for Him to rest. The Police would torture Him making the floor wet and adding ice.
• He had no human rights in prison, he was isolated and made helpless nobody could visit Him, he couldn't take any help of any lawyer or legal representative.
• When he came out of prison, they issued orders that he should not speak after leaving the prison.

It was a gross violation of human rights of subjecting to torture, cruel inhuman, degrading treatment and punishment (United Nations Declaration of Human Rights - Article 5) and arbitrary arrest, detention or exile (Article 9).

Bail 'conditions' suspended the fundamental Human Rights & Freedom of speech

(Following are the extracts from the bail order)

*Essence:*More than 50 witnesses, devotees, disciples and various people were remanded, interrogated and harassed by the State prosecution, but all of them gave statements only in support of His Divine Holiness and his divinity; no offence by His Divine Holiness got indicated.

undoubtedly hurts the sacred sentiments of devotees. But the clips do not support fake rape (376) charges.

Essence; There is no material to support any of the allegations of rape or any of the other allegations. Just based on allegations, a person cannot be denied 'right to life'.

Even the Investigation Officer said, "there is no material to support any allegations".

Propaganda for Justification of Persecution:

Essence: The Court is clear that the matter cannot be discussed as it has been distorted by the Media character assassination of the image of His Divine Holiness.

However, since His Divine Holiness is at a position of high respect and regard in the Hindu society there should not be even one iota of doubt on his image and His Divine Holiness must come out of the persecution demonstrating strong determination and courage living up to the

expectation of the people.

Unjust Bail Conditions - Human Rights Suspended

conditions:
0	Petitioner shall execute a personal bond for a sum of Rs.1,00,000/ - and two local solvent sureties for the likesum to the satisfaction of the court:
ED	He shall not leave the jurisdiction without the permission of the jurisdictional court.
(i)	He shall mark his attendance once in 15 days before the jurisdictional Police:
(1.9)	He shall also not undertake any preaching or classes except performing yoga till the investigation is completed and

● Freedom of Speech, freedom to impart religious discourses indefinitely suspended.

● Freedom to travel suspended : Cannot leave the jurisdiction without court permission.

● Cannot preach or conduct any program till investigation is complete.

● Has to sign in a register in the local Police station every 15 days.

The inhuman bail conditions were a direct violation of the fundamental right of speech and practicing one's

religion as enshrined in the Constitution of India as well as violation of the fundamental human rights of freedom of thought, conscience, and religion to manifest his religion or belief in teaching, practice, worship and observance. as per the United Nations Declaration of Human Rights - Article 18.
